Terms of Service

1. Introduction

These Terms of Service (the "Agreement") govern the use of all services provided through the KOF platform (kofbot.com). The platform is operated by KOF from the Republic of Turkey. By registering on our platform, creating an account or using our services, you confirm that you have read, understood and accepted all provisions of this Agreement. If you do not accept these Terms, you must not use the platform.

KOF is a platform comprising AI-assisted private bot services, a forum community, live chat, an e-commerce store, a support system and all related digital services.

2. Definitions

• "Platform": the kofbot.com website and all digital services belonging to KOF.
• "User": any natural person who registers on or uses the Platform.
• "Bot Service": the AI-assisted private bot software and automation solutions provided by KOF.
• "Service": the bot services, forum, store, chat, support and all other features offered through the Platform.
• "Content": all text, images, files and data uploaded to the Platform by Users or by KOF.
• "Product": the bot packages, licences and digital products offered for sale in the store.

3. Account Registration and Security

• To use the Platform, you must create an account with a valid email address.
• You must provide accurate and up-to-date information when creating your account. Providing false or misleading information may result in the suspension or closure of your account.
• You must be at least 18 years old to use our Platform.
• Each user may create only one account. Opening multiple accounts is prohibited and, if detected, all of the accounts concerned may be closed.
• You are solely responsible for keeping your account credentials (username and password) secure. You are responsible for all activities carried out through your account.
• If you detect unauthorised access to your account, you must notify us immediately at [email protected].
• Sharing, transferring or selling your account to third parties is strictly prohibited.

4. Use of Bot Services

KOF private bot services provide software solutions designed to automate in-game processes. By using the bot services, you are deemed to accept the following conditions:

• The bot services are provided for personal use only. Resale or distribution for commercial purposes is prohibited.
• Attempting to reverse engineer, decompile, modify or copy the bot software is prohibited.
• Any in-game sanctions (bans, account closures, etc.) that may result from using the bot service are entirely the user's responsibility. KOF cannot be held liable for sanctions arising from the policies of the game's developers or publishers.
• Sharing, renting out or transferring the bot software to third parties is strictly prohibited.
• The bot's performance may vary depending on your internet connection, hardware, the status of the game servers and third-party factors. KOF does not guarantee uninterrupted or error-free service.
• If misuse of the bot services is detected (overloading servers, harming other users, etc.), your account may be suspended or closed without notice.

5. Store and Payment Terms

• All products offered in the store are digital products. Delivery takes place at the moment of purchase.
• Payments are processed through secure third-party payment providers. Your credit card details are not stored by KOF.
• Due to the nature of digital products, there is no right of withdrawal or refund after purchase (pursuant to Turkish Law No. 6502 on Consumer Protection, Article 53(ç)).
• Product prices may be changed without prior notice. Price changes do not affect existing subscriptions.
• Your invoice and payment information is retained for a certain period as required by law.
• Promotional codes and discounts are subject to specific conditions and may be changed or cancelled by KOF at any time.
• For subscription-based products, if the subscription is not renewed when its term expires, the service stops automatically.

6. Forum Rules

The KOF forum is a community space provided for users with an active subscription to share information and obtain support. Access to the forum is available only to active subscribers. The following rules apply to the use of the forum:

• Posting content that contains insults, profanity, hate speech, discrimination or harassment is strictly prohibited.
• Posting spam, advertisements, duplicate content or meaningless messages is prohibited.
• Disclosing other users' personal information (doxxing) is prohibited.
• Sharing illegal content, pirated software or malicious links is prohibited.
• Forum moderators' decisions must be respected. Moderation decisions may be appealed via the contact page.
• You are legally responsible for all content you post. KOF cannot be held liable for content posted by users.
• KOF reserves the right to remove content that violates the forum rules without notice.
• Your forum access may be restricted temporarily or permanently due to rule violations.

7. Chat Rules

• The live chat feature is provided for communication between users and for support.
• All content rules set out in the forum rules also apply to chat.
• You should avoid sharing personal information (passwords, payment details, etc.) via chat. The KOF team will never ask for your password.
• Mass messaging (flooding), automated messaging via bots and spam are prohibited.
• Chat history may be retained for a certain period for service quality and security purposes.

8. Intellectual Property Rights

• All software, designs, logos, graphics, texts and other content on the Platform are the intellectual property of KOF and are protected under Turkish Law No. 5846 on Intellectual and Artistic Works.
• Copying, reproducing or distributing KOF content, or creating derivative works from it, without written permission is prohibited.
• Users retain their rights to the content they post on the Platform; however, they are deemed to grant KOF an unlimited, irrevocable licence to use, display and distribute such content within the scope of the Platform.
• The names "KOF" and "KOFBot" and their logos are registered trademarks. Unauthorised use is prohibited.

9. Prohibited Conduct

The following conduct is strictly prohibited and, if detected, your account may be closed without notice:

• Actions that endanger the security of the Platform (hacking attempts, DDoS, SQL injection, etc.).
• Unauthorised access, or attempted access, to other users' accounts.
• Using software or scripts that may damage the Platform infrastructure.
• Creating fake accounts or impersonating others.
• Misusing the bot services or using them to harm third parties.
• Committing fraud or deceptive transactions in payments.
• Conducting illegal activities through the Platform.
• Threatening or harassing other users, or misusing their personal information.
• Using the Platform for automated data collection (scraping, crawling), i.e. unauthorised bot access.

10. Service Changes and Interruptions

• KOF reserves the right to change, update, suspend or discontinue its services with or without prior notice.
• Planned maintenance will be announced in advance whenever possible.
• KOF cannot be held liable for service interruptions caused by force majeure events (natural disasters, war, cyberattacks, infrastructure failures, etc.).
• KOF is not responsible for interruptions caused by third-party service providers (payment, hosting, game servers, etc.).
• KOF has the right to add, remove or change features of the Platform at any time.

11. Limitation of Liability

• KOF cannot be held liable for any direct, indirect, incidental, special or consequential damages that may arise from the use of the Platform.
• KOF is not responsible for in-game sanctions, account losses or data losses resulting from the use of the bot services.
• The Platform is provided "as is". KOF gives no warranty that the services will be uninterrupted, error-free or completely free of security vulnerabilities.
• In all cases, KOF's total liability may not exceed the total amount paid by the user to KOF in the last 12 months.
• KOF cannot be held liable for damages caused by user-originated security breaches (weak passwords, account sharing, phishing, etc.).

12. Privacy and Personal Data

Detailed information on how your personal data is processed, stored and protected is available on our Privacy Policy page. KOF, based in Turkey, is the controller responsible for the processing of your personal data. By using the Platform, you acknowledge that your personal data will be processed as described in the Privacy Policy. 13. Account Suspension and Closure

• KOF reserves the right to suspend, temporarily or permanently, or to close a user account in the event of a breach of this Agreement.
• If an account is closed, the user loses access to all of their data, purchased products and services on the Platform.
• Users may request the closure of their account at any time via the contact page.
• Upon an account closure request, personal data will be deleted within a reasonable period, except for data that must be retained to comply with legal obligations.
• Accounts in which fraud, misuse or a security threat is detected may be closed immediately and without notice.

14. Third-Party Links and Services

• The Platform may contain links to third-party websites or services. KOF is not responsible for the content, privacy practices or security of such third-party sites.
• Payments are processed through third-party payment providers, and those providers' own terms of use apply.
• The Google reCAPTCHA service is used for bot protection and is subject to Google's terms of service.

15. Notices

KOF may communicate with its users through in-platform notifications, email or announcements on the website. Notices sent to the email address registered to your account are deemed to have been delivered. You are responsible for keeping your email address up to date.

16. Dispute Resolution and Governing Law

• This Agreement is governed by and construed in accordance with the laws of the Republic of Turkey.
• The Courts and Enforcement Offices of Istanbul have jurisdiction over all disputes arising from this Agreement.
• In the event of a dispute, a solution will first be sought in mutual good faith.
• Nothing in this Agreement limits the mandatory consumer rights granted to you by the laws of your country of residence; those rights remain unaffected.

17. Changes to this Agreement

KOF reserves the right to update these Terms of Service at any time. When significant changes are made, our users will be informed by email or in-platform notification. Continuing to use the Platform after the changes are published means that you accept the updated terms. The most current version of the Agreement will always be published on this page.

18. General Provisions

• If any provision of this Agreement is found invalid or unenforceable, the validity of the remaining provisions is not affected.
• KOF's failure to exercise, or delay in exercising, any right under this Agreement does not constitute a waiver of that right.
• This Agreement constitutes the sole and entire agreement governing the relationship between the user and KOF and supersedes all prior written and oral agreements on the subject.
• The user may not assign the rights and obligations arising from this Agreement without KOF's written consent.
